DUI Laws and Penalties
North Dakota laws regarding DUI and drunk driving are pretty straightforward. First-time offenders may face misdemeanor charges, along with a $500 to $700 fine and 91 to 180 day license suspension. Penalties increase in length of suspension and the amount of fines for subsequent offenses. If a person is convicted of a fourth drunk driving offense in North Dakota, he or she will be charged with a felony and will be sentenced to one year imprisonment and a $2,000 fine, along with addiction evaluation, one year of supervised probation and one year in the 24/7 program.
North Dakota Zero Tolerance Laws
North Dakota has a zero tolerance policy for anyone under 21 years of age who operates a motor vehicle with a blood alcohol content (BAC) of .02 percent or above. Penalties for breaking these laws are imprisonment and license suspension for a first offense, and imprisonment for up to a year for a second offense within a five-year period.
